MEMBERSHIP TERMS AND CONDITIONS

MEMBERSHIP DETAILS
Persons under the age of 18 (“Minors”) must provide their parents’ or legal guardians’ consent for payment authorization, liability waiver, intake, and POLISHED membership application. By enrolling in the POLISHED Life Preferred Plan (“Membership”), the Member (“you”) agree (or, if you are a Minor, your parent or legal guardian agrees) to be bound by these terms and conditions and the terms set forth on the Membership application. 

Membership includes our Membership Discount regardless of how you customize your Membership. Discounts include a $5.00 reduction in price of each base service price for polishing one time a month. If you select polishing two times a month, you will receive a $15.00 reduction in price each base service price. Members additionally receive free gel removal, free French or American manicure upgrade, and a free manicure to celebrate the member’s birthday. Members also receive a 10% discount on all retail products purchased and a 5% discount on any add-on services such as nail art. Memberships are non-transferable and can only be used by the member. Membership fees cannot be returned or used for other services regardless of usage. If payment does not process successfully, the membership will automatically become inactive until payment is made. Any lost time that results from payment processing failures will not be reimbursed or credited. Membership fees cannot be prorated.

BILLING
All memberships activate on the day of their first appointment and auto renew based on the membership billing cycle. Memberships are billed on the first of every month. If members upgrade or downgrade their membership from one membership tier to another, their new membership will activate on their next billing date. Prices for membership eligible services are subject to change, and rates and available services may vary by Membership location. POLISHED does not hold your credit card information and handling your credit card information is completed by a third-party Soham Inc., d/b/a Zenoti, a Delaware corporation.

FREEZING MEMBERSHIPS
Members may freeze their membership for a maximum of 2 months annually. To freeze the account, members must reach out through our contact us page and complete the freeze form. The freeze will start on the next billing cycle. After the freeze, POLISHED will resume membership charges. Freezes are not processed in store. Membership fees cannot be prorated based on freeze time.

CANCELING MEMBERSHIPS
Members may request to cancel their membership at any time by providing ten (10) days written notice prior to your next billing cycle (which begins on the first of each month) through our contact us page. Members will receive a cancellation form. From there we will process the cancellation once the member cancellation form has been submitted. Cancellations are not processed in store. Cancellations are not final unless our form is submitted. If cancellation is submitted within the 10 day period you will be charged for your upcoming billing cycle and will not be refunded. You will still have the ability to use your membership until the following billing cycle where your membership cancellation will be processed. When cancelling any type of membership for any duration, membership fees paid will not be prorated based on the date of cancellation and no membership fees already paid will be returned.

BILLING DISPUTES
Members will automatically be charged any bank fee imposed on POLISHED, plus a processing fee of up to $25, for any returned payment due to closed accounts, insufficient funds, or other reasons. If this occurs, POLISHED retains the right to collect the current and past due balances in any month after the returned payment. In the event that a Member initiates a credit card dispute that is subsequently resolved in POLISHED’s favor, POLISHED shall have the right to charge the Member or Participant up to $50 per occurrence. Members or Participants who dispute a valid charge for a late cancellation or no-show will be subject to this $50 fee.

CANCELATION OF MEMBERSHIP
POLISHED reserves the right to cancel your membership at any time with immediate effect if you are found to be in breach of the terms of your membership. All Members are expected to treat our employees, other clients and visitors with the utmost respect and dignity while at our POLISHED locations. Any breach of this policy may also cause a termination of your membership.

PRIVACY POLICY
At POLISHED, we value your privacy. Our collection of your personal information and how we use it (if applicable) is governed by our privacy policy. By submitting a Membership Application, you agree to receive marketing materials and other communications by email from POLISHED. If you do not wish to receive these communications you can request that they be discontinued by following the opt-out procedures described in our privacy policy or on the communications themselves. 

ASSUMPTION OF RISK, RELEASE, WAIVER OF LIABILITY, AND INDEMNIFICATION
You understand, acknowledge, agree and hereby voluntarily accept all risk and responsibility associated with the services provided and use any of the facilities at any POLISHED location. You hereby waive all claims, assume all liability, and release, hold harmless, indemnify, and agree to defend POLISHED (including our affiliates, agents, and employees) and POLISHED’s franchisees and affiliates from liability for any injury, claim, cause of action, suit, demand, and damages (including, without limitation, personal, bodily, or mental injury, property damage, economic loss, consequential damages, and punitive damages), arising from or related to (1) your failure to disclose any pre-existing conditions, limitations, or sensitivities; (2) your failure to inform us of discomfort or paint during or at the end of the service; or (3) your presence on the premises of any POLISHED location; and/or (4) any negligence on part of POLISHED, it’s franchisees, our or their employees, or on the part of any other POLISHED franchisee or affiliate. You further expressly agree that this Assumption of Risk, Release, Waiver of Liability, and Indemnification is intended to be as broad an inclusive as permitted by law and that if any portion of it is held invalid, the balance shall be valid and continue in full legal force and effect. These provisions are binding on your estate, family, heirs, administrators, personal representatives, and assigns. 

OFFERS
To qualify for and receive any promotion and/or credit (collectively, “Offer”) you must meet the requirements indicated, as applicable, in the Offer. You must have a valid POLISHED account with a valid form of accepted payment on file to take advantage of an Offer. For Offers available to new customers or new members only, as applicable, customers will be disqualified and will not be entitled to receive the Offer if POLISHED has a record of their name, email, phone number, or credit card having been used for a prior POLISHED purchase of a product or service, or being linked to an existing active or inactive POLISHED account or otherwise suspected of fraudulent activity. Offers cannot be combined unless otherwise indicated. Terms of Offers are subject to change by POLISHED at any time. We reserve the right to modify or cancel an Offer at any time. Offers shall be void where restricted or prohibited by law.
